you have to "cover" otherwise the short never clears.

Never clears? lol

To legally short, you borrow the shares ( from a broker) and pay a % for the service. The shares are deposited in your account and you sell them. The money goes into your account. The shares go thru the MM's to the DTCC and are cleared. If the company goes bk, then the stock will not trade and have no real value. The stock couldn't be purchased and given back to the broker. That's my take on it...dog
