I strongly disagree with your contentions, On a Reg-FD-violation scale of 1 (least consequential) to 10 (most consequential), this one (assuming it happened) is about a 4.5.

Because of the fact that I consider the info less material than you do - and because of the fact that they seem to equally disclose to everyone who asks, I'd put it at a 2.5. (With a 2.0 being, for example, all of the data coming out of Dendreon about the alpha assignment. And I am sure I could find a ton of 2.0 data coming out of GTCB or MNTA as well.)
