So then who or what is the deciding factor? If the Supreme Court makes a decision, can a lower court overrule? I would think if the SEC gives clearance, the "scam" theory on Lbwr is moot, unless proven otherwise in the future. Btw, old records, prs etc are not part of it since (ahem, I assume) the SEC was cognizant and due to recent amended filings, gave the okay.
