The New CD has a "no short clause in it". A R/S will do nothing to pay off the debt, the market cap of the company with just over 2 billion shares right now is at $205K. If he continues dumping until he hits the full 6.5 billion shares, the market cap will still only be $650K. So you can talk R/S all you want, it's a useless tool to use under the circumstance.
