I think the key though is the "super" preferred share class they created. Those typically have superior voting rights and preferential liquidation-- even so far as disbursing to preferred shareholders the liquidated assets prior to satisfying liabilities.
It would not surprise me to find out that type of structure wasn't present for that share class as that would be their "golden parachute"
