This is where the voting rights to the Preferred Shares & Articles of Incorporation are important to understand as they relate to the statutes.
We don't know with exactness what they state as it relates to voting, but a very good speculation is that they gave unanimous/majority voting ability without having to include/count all votes.
I've mentioned this in PMs that I still feel the wording of the statute would require notification of the vote to be sent to all shareholders & that that may be a course of action to take against the company.
