When they decided not to include the license deals they announced in Feb. in the last 10Q, I became very suspicious.
I had a hunch there was some reason they wanted to wait for the next 10Q to report. As it turns out, if not for those deals, this quarter would have nothing to report.

Now, as to why there is no licensing activity going on now.
With all the confusion about the settlements with the J's, who in their right mind would buy a license now? With the NDA in effect, and no public announcement as to why the case was settled, and did not go to court, it has created a lot of confusion. I wouldn't spend millions of dollars for a license I may not need. The settlement with the J's was apparently a lot less than what was expected. And look at the other side of the coin,if you are TPL are you going to let any big fish off the hook now? Give them as sweat a deal as the J's got? No, I don't think so. If we won the Markman ruling, which we did, then the lone issue would have to be validity. Perhaps everything has been put on hold until the USPTO does their re-exams. Hopefully, that will be sooner rather than later. It may have been wiser to orders these re-exams ourselves years ago, but with our own litigation over ownership it kind of was an after thought I guess. Now it seems the T3 are pushing to have their case settled before a re-exam is completed. In our case, it is better to have USPTO decide the validity issue. An ex-parte re-exam by the USPTO cannot be appealed by anyone but us. Huge advantage!! If we don't get the ruling we want we appeal, and get another shot at it , they don't. They cannot argue their case to the exaiminer, they can only request a re-exaim. On the other hand, we sit with the exaimner and give them our points. item by item. Huge advantage!!If the court decides validity we loose all those advantages.

I, myself, didn't believe that the settlement with the J's included everything that has been reported to date. I can't image, with the scope of infringement, that they got off so cheap. I wrote to Hawk to this effect and they validated that there is nothing more to come. I can;t see how it is possible and am having a difficult time accepting it. But unless someone is out and out lying, there it is, and here we are!.
