The latest BK filing was regarding our attempt to hire an attorney to go after Capwest in regards to lender liability. The Trustee has objected to the company hiring them with one of the reasons being that we did not previously employ them before filing the BK.
But there is no reason that a shareholder couldn't pursue them according to this:
"It may be that Sprouse Shrader’s investigation reveals an action that might be prosecuted by a shareholder, derivatively or otherwise. In that event, the shareholder, as holder of the “purse strings” would control the litigation and might to so in competition with the Debtors’ administration of the estates."
A little birdy told me that our largest shareholder is working on this.
