Although I pretty much agree with you on this, that boilerplate forward-looking blurb at the bottom of the PRs covers them in my opinion. That's why they can act with gum-chewing confidence whenever they're questioned about anything. That's the way things are legally structured in this wonderful world. They win, we lose, it's all legal.
