Let's talk Big Apple first. They were the firm's IR consultant. If they had legal access to the DTC sheets and should have or did know that what Plant was issuing as financials did not match the transfer agent's share count, then they may be culpable in civil court.

Hank's legal problem hs nothing to do with CyberKey. Don't take my word for it. Look up the legal case. It has nothing to do with CyberKey. I believe Hank was fooled the same way that Sullivan was fooled. I know from speaking to Hank that he saw what he thought was a copy of the DHS contract. I'm sure that Big Apple saw it also. I'm told it sure looked official. Others have their opinions as to what happened with Hank. He shot off his mouth when he shouldn't have on this board about helping Plant to meet the people that introduced him to the DHS people. Actually, Plant told me a completely different story on this, but clearly no story is true.

Now let's talk Heaton. In some ways I feel sorry for the moron. In no uncertain terms, he was the CFO, an officer and director of the company when the fruad was committed. He's going down. Whether he was simply a clueless moron, a step above house plant, taking orders from Jim or simply a guy who took the job for a friend and figured he didn't have to show up or take his fiduciary responsibility seriously I can't say. Either way, it appears that the Feds are convinced that Heaton had nothing to do with the crime itself. That same thinking is not going to save Heaton from civil penalties, however.
