ITC initiates Tessera-requested DRAM action
The International Trade Commission has begun an investigation into the allegedly unlawful use of Tessera?s patents by certain DRAM devices and products incorporating them.

Tessera Technologies Inc today provided a status update regarding its legal actions filed with the U.S. International Trade Commission involving DRAM and wireless technologies.

According to the San Jose-based packaging, interconnect, and consumer optics provider, on January 3, the ITC initiated an investigation into the allegedly unlawful use of Tessera’s patents by certain DRAM devices and products incorporating them.

Tessera requested the investigation in a complaint filed on December 7, 2007, naming as respondents A-DATA Technology, Acer, Acer America, Centon Electronics, Elpida Memory, International Products Sourcing Group, Kingston Technology, Nanya Technology, Peripheral Device and Product Systems, Powerchip Semiconductor, ProMOS Technologies, Ramaxel Technology, SMART Modular Technologies, and TwinMOS Technologies. The investigation has been assigned ITC reference number 337-TA-630 (the 630 investigation). No trial date has been set for this investigation.

The 630 investigation is one of many legal actions Tessera is currently working through and comes in addition to a currently pending ITC action involving chips found in wireless handsets, among other products (investigation 337-TA-605 or the 605 investigation). According to Tessera, on January 2, Judge Theodore Essex rejected a request to delay the hearing date for the 605 investigation, keeping it on schedule to run for 5 days beginning February 25.

The named respondents of the 605 investigation include ATI Technologies, Freescale, Motorola, Qualcomm, Spansion, and STMicroelectronics, among other companies.

In both ITC actions, Tessera is seeking an exclusion order barring the importation, sale for importation, or sale after importation of products that the company believes infringe its technology and are unlawfully competing with products from its licensees.

Specifically, Tessera is seeking remedies for the alleged infringement of U.S. patents 5,679,977; 6,133,627; 5,663,106; and 6,458,681 in the 630 investigation, and U.S. patents 5,852,326 and 6,433,419 in the 605 investigation. All six patents are part of a portfolio of technology that is “broadly licensed” to companies in the semiconductor industry including market leaders such as Intel, Hynix, Micron, NEC, Qimonda, Samsung, Texas Instruments, and Toshiba, the company said.
