Burst DVR patent facts refute unsubstantiated BS (plus interests conflicting with objectivity and convenient omission of links) in this thread

1 – “final rejection” of a patent sounds like the end to the uninformed, but that is not necessarily true. On its face that was not the end of the Burst DVR patent because it was subsequently granted. This is fully consistent with 37 CFR 1.114, by which the applicant may obtain continued examination of an application by filing a submission and paying a specified fee, even if the application is under a final rejection. Upon the filing of this Request for Continuing Examination (and fee), the finality of the last Office action is withdrawn.

2 – The similarities between the Burst patent and the filed-later Tivo patent are striking and widespread. No debate is needed. See and read for yourselves.

3 – the similarities between the two patents means that any new post-KSR rationale regarding obviousness applying to the Burst patent could just as easily be applied to the Tivo patent. So be careful in raising this issue here, Tivo boosters and DISH shorts.
