There is no stated regulation that requires a paid basher to disclaim.

Sure there is. Rule 17(b). Anyone who's paid to make public statements about any stock is required to make disclosure of that fact, and of the amount paid. I see no reason why that wouldn't apply equally to pumpers and bashers.

Further, the SEC has said, right there on its website, that it's willing to go after paid bashers. But they've never done that, presumably because they never found any. And God knows the Feds get thousands and thousands of complaints about "bashers" every year.
