How about the Military Commissions Act of 2006 and its elimination of habeas corpus?
Justice Scalia wrote in the Hamdan vs Rumsfeld case that "the very core of liberty secured by our Anglo-Saxon system of separated powers has been freedom from indefinite imprisonment at the will of the Executive. "
That very core of liberty died on October 17, 2006 with the signing of the Military Commissions Act of 2006 and its elimination of habeas corpus.
