I've studied this situation forwards and backwards along with Accel Energy. Unfortunately, I can't be part of the company board room talk so I can only put 2 + 2 together from what I've learned. Let's say nothing happens with a merger and AAPU revenues grow to $50+ mil this year with profits and no action from the patent. This is still a sizable operation for a small cap. And, to be trading at this level with a reasonable low o/s.

I don't see "nothing" happening for sure. The R/S is the first step of bigger things coming IMO. Patience!
