Dick is handling this situation as well as anyone could have hoped for. I am extremely impressed. If the stock doesn't gap up after the halt it will be the surprise of the year for me. I agree completely with what many here are saying: this whole thing could turn out to be the best free DD any of us ever received on a penny stock.
I would also like to point out that during the interview, Dick stated multiple times that he was fine with people taking profits. This suggests that his "infamous pr" about withholding news was not about the pps, it was about the callers who were harassing him.
In addition, I e-mailed the SEC the day of the suspension asking why they halted DCBI. What follows is their response, followed by my inquiry. There isn't much info to garner from their reply; the main point is, if you were going to contact the SEC to have questions answered, don't bother:
Dear Mr. ||||||,
Thank you for contacting the SEC. We appreciate that you have taken the time to alert us of your concerns. I am following-up on the automatic response you received from Lori Schock, Director of OIEA.
As I sure you can understand, I am limited to providing information that is publicly available on the SEC website. See http://www.sec.gov/news/press/2007/2007-34.htm and links contained in our press release. As stated in the release, Mark K. Schonfeld, Director of the Commission's Northeast Regional Office, said, "By halting trading in these stocks we are seeking to protect investors from further harm. But this is only the first step. Our investigation of the perpetrators - the people behind this misconduct - is continuing."
Please be aware that the SEC conducts investigations confidentially. We do this for two main reasons: First, we can conduct investigations more effectively if they are not announced publicly. For instance, important documents and evidence can be destroyed quickly if people hear of an investigation. Second, investigations are kept confidential to protect the reputations of companies and individuals if we find no wrongdoing or decide we cannot bring a successful action against them. As a result, the SEC will not confirm or deny the existence of an investigation unless, and until, it becomes a matter of public record.
An investigation becomes public when the SEC files an action in court or in its internal administrative process. You can find information about public enforcement actions on our website.
If you have further questions, please do not hesitate to contact me.
Sincerely,

Subject: Question Concerning Operation Spamalot
Sir/Ma'am,
I am an investor who is concerned about the recent halting of some 35 pink sheet companies - specifically, DCBI. I have owned and followed this stock closely for about a year now, and I know quite a bit about its dealings. My primary purpose with this e-mail is to try to garner more information as to exactly why it has been halted. I am aware of the following statement made by the SEC:
DC Brands International, Inc., is a company incorporated and based in Colorado. Questions have arisen regarding the adequacy and accuracy of press releases concerning the company’s operations.
However, the official press release by the SEC only discussed a concern over "third party spamming." Clearly the above concern is not over any such thing. Am I to assume that every prink sheet stock out there is having its operations checked to ensure that they align with their PRs? The SEC indicated that its "spam detectors" were the alarms that brought their attention to these 35 companies, however given a lack of 3rd party pumping, I don't see how that could possibly be the case. DCBI has been a bearish stock for months now, and after about a week of good trading, it is suddenly suspended during a 3rd party spam-blocking campaign by the SEC? The dots do not connect.
When you consider DCBI as a whole in terms of its business experience, it is in many ways a rare find: it is a company who, after starting out, acquired the capital to produce its product, acquired business contacts and contracts, saw its stock increase, and then was slammed by misfortune and faulty production. After that, the stock plummeted, but the contacts were not lost, the capital was still there, and the business was savvier than ever. Hence, DCBI's stock was grossly undervalued, and remained as such as they doubled their number of viable products, increased their number of contacts and contracts, and continued to make a name for themselves. When investor confidence finally returned, the stock was in a position to not just increase, but to make up for months of undervalued time during the company's growth. This is why the PPS recently exploded. The news was real, but if the government was concerned, why didn't it investigate before suspending?
I would like more information as to precisely why DCBI has been suspended. As a partial owner I have a right to this information, as it is my Concern which the government has halted.
Thank you for you time.
Respectfully,
||||||||||||
