EEOC sues NYT outlet, alleging discrimination of White male employee

The United States Equal Employment Opportunity Commission (EEOC) has announced a lawsuit filed against the New York Times (NYT) outlet for DEI-related race and sex discrimination, according to an EEOC press release.

The federal lawsuit, filed on Tuesday, alleges that the publisher denied a promotion to a White male employee based on his race and/or sex.

“The New York Times has a well-documented commitment to enacting race and sex conscious decision-making in the workforce through its diversity, equity, and inclusion (DEI) policies,” the release stated.

The EEOC contends that a longtime NYT editor, a White male, was excluded from the final round of interviews for the Deputy Real Estate Editor role in early 2025, despite having extensive experience in real estate journalism. The commission further alleges that none of the candidates who advanced were White men and that the position ultimately went to an external hire — a non-White woman with little to no background in real estate journalism, even though such experience was listed as a job requirement.


The commission also cited additional irregularities in the hiring process, including that the selected candidate received a lower final interview panel rating than two other finalists.

“No one is above the law — including ‘elite’ institutions. There is no such thing as ‘reverse discrimination’; all race or sex discrimination is equally unlawful, according to long-established civil rights principles,” said EEOC Chair Andrea Lucas.


As a basis for the suit, the EEOC also pointed to Title VII of the Civil Rights Act of 1964, which prohibits discrimination on the basis of race or sex.

“The New York Times has a well-documented commitment to enacting race and sex conscious decision-making in the workforce through its diversity, equity, and inclusion (DEI) policies,” the release stated.


Following the announcement, the NYT denied the allegations in the lawsuit in a statement from Senior Vice President of Communications Danielle Rhoades Ha.

“The New York Times categorically rejects the politically motivated allegations brought out by the Trump administration’s EEOC. Our employment practices are merit-based and focused on recruiting and promoting the best talent in the world. We will defend ourselves vigorously,” Ha said.

She also accused the EEOC of deviating from standard practices, arguing that the allegation focuses on one personnel decision to make “sweeping claims that ignore the facts to fit a predetermined narrative.”

“Neither race nor gender played a role in this decision — we hired the most qualified candidate, and she is an excellent editor,” she claimed. “The New York Time’s commitment to diversity in all its forms is longstanding and unwavering, as is our commitment to a fair and legal hiring process that does not discriminate against anyone.”


The EEOC, on the other hand, asserted that the company has a history of employing DEI principles in its hiring decisions, further alleging that through numerous publications, “the company stated goals and action plans to increase non-White and female representation in its leadership positions.”
