if there is an NDA that precludes that info from being released, it cannot be released...

"material event" is a term with broad interpretations and not easily defined in every circumstance...certain circumstances are clear cut but delivery of product?...thats not one of them...the SEC would consider that a regulatory or administrative issue...

an NDA is a contractual agreement that can result in a breach of contract...
