Could they not rely on level two at this time, but ,at a later date, apply level III?
If so, perhaps,as I would, use level two to justify and validate the complaint, but hold back on Level III for several reasons 1) Hold that over the defendants as a negotiating tool, ie we won't disclose if you give a great settlement. 2) We won't disclose at this time, to save these wild cards until it is time to unleash then, AFTER FULL AND COMPLETE DISCOVERY. 3)) We won't diusclose them NOW, because we want to catch the defendants in a fraud, thereby justifying and establishing fraud AND MASSIVE PUNITVE DAMAGES.. 4) If the defendants do not know what we have , they will act in a different way than if they knew exactly what we had.
