That framing is simply incorrect. The claims were dismissed because the plaintiffs could not meet their burden of proof, full stop.
The court did not “avoid” the accusations, the case failed because there was no legally sufficient evidence to support them.
Suggesting that HMBL’s own counsel “admitted” the accusations were never addressed is a misrepresentation of how litigation works. Courts do not reach merits-based questions when plaintiffs cannot first establish standing, damages, or viable claims. That is not a technical dodge, it is the legal system functioning as designed.
You don’t get to bypass the burden of proof and then declare moral victory because you failed to clear it. If the plaintiffs had evidence of wrongdoing, the case would have proceeded. It didn’t, because they couldn’t substantiate their allegations.
Rewriting a dismissal as anything other than a defense victory is spin, not fact.
