It actually was prior to Nuremburg. It took over four years and several different applications until the London Agreement was reached. It was only after such that Nuremburg could begin. And to be frank, the atrocities committed during WWII were certainly beyond the law...like way beyond. They had to bring the law to it in order to schieve the goals of Nuremburg.

The Roman accord was placed in 1998...with no jurisdiction until 2018. They are currently ammending such:

That was the only tim that a couple dozen plus were harged with crimes of aggression. Given the latitude of Germany's and Japans actionds---such could never apply today. Because if such was attmepted..there would not be a tomorrow.

And lastly...absolutely no individual since that time has been charged with the crime of aggression(war/invasion).
