to be several issues with Tony's counter claim, but I'm no lawyer.
Slander is spoken; libel is written. Tony seems confused, but he's not an attorney either. His counter claim is for slander, not libel.
Further, Tony submitted no exhibits.
Where's the call log? Nothing has been submitted ahead of the hearing. Where's the libel/slander proof?
He also admits the Defendant allowed Brugg to do whatever for some time, which caused damage. See the first sentence in the counter claim I showed earlier. He could have filed something sooner instead of allowing the damage to continue, right?
Did you know Brugg was doing what Tony claims? I never heard of the guy.
Instead of Tweeting pics on a plane, why wasn't he warning shareholders?
I think Tony thought the $40MM counter claim would scare Brugg off, that's all.
We'll see in about 6 weeks how it plays out. You never know. Tony might find favor, but these things are about procedure too. You could be 100% right and not present the argument as the law/rule prescribes.
