OK, you don't deserve the comprehensive response/refutation posted below, but the board does. Unless you can come up with something equally as comprehensive/persuasive to refute it....pulled from your ass doesn't count... then you really do need to STFU on the subject.

Geez — an accounting error was a misdemeanor— statue of limitations had run

Geez....

Why was trump convicted of felonies and why didn't the charges violate the statute of limitations?

Answer

Donald Trump was convicted of 34 felony counts of falsifying business records in the first degree in New York. The conviction stems from a scheme to conceal hush money payments made to adult film star Stormy Daniels before the 2016 election123.

The Felony Charges
The charges were elevated from misdemeanors to felonies because prosecutors argued that the falsification of business records was done with the intent to commit or conceal another crime4. Specifically:

The falsified records were allegedly used to hide payments made to Daniels to keep her quiet about an alleged affair with Trump.

Prosecutors claimed this was done to unlawfully influence the 2016 presidential election.

The scheme allegedly involved violating campaign finance laws and tax fraud10.

Statute of Limitations

The statute of limitations did not bar these charges for several reasons:

Extended Deadline: In New York, the statute of limitations for felonies is typically 5 years. However, due to a COVID-19 pandemic extension, prosecutors were given more time46.

Tolling Period: Judge Juan Merchan ruled that the tolling deadline was extended to May 6, 2021, giving prosecutors 6 years and 47 days from when the crimes were committed to bring charges10.

Continuous Absence: New York law allows for tolling of up to five years while the defendant is continuously outside the state. Trump spent most of his presidency outside New York, which may have further extended the deadline10.

Felony vs. Misdemeanor: While the statute of limitations for misdemeanors is 2 years in New York, the charges against Trump were elevated to felonies, which have a 5-year statute of limitations11.

It's worth noting that Trump's legal team has challenged the timing of the charges and may continue to do so on appeal7. However, as of now, the court has ruled that the charges were brought within the allowable timeframe.
