Thank you rapz for a most authoritative and comprehensive review of Hudnell's arguments. It is blatantly obvious that this judge failed to do his homework and is now getting spanked for it. Hudnell makes a compelling argument for a reversal of this atrociously erroneous ruling which relied on a wrong precedent, an error of law. Granted, the technical material involved is complex and can be quite confusing for anyone who is not an expert in the field, and I think that the defendants took full advantage of this judge's ignorance in this area. But it all goes back to claims construction. I think that Judge Albright must go back and do his homework on this case and correct this egregious error in order to avert a manifest injustice. JMHO.
