Ex Parte Reexamination indicates the patent office made some sort of adjustment to the patent. This would make the case stronger. However, the company still needs to explain what happened in the ending of the trials for the gateway patent. There is no indication of a settlement. Anyone saying that the company may not be able to tell us is wrong. SEC rules would say that the company has to release any news to the general public that is material to the stock price. It the trial ended with nothing in return it is material and if T-Mobile has settled with a monetary component it is material. Either way the company is responsible for releasing the information within 48 hours.
