The DC Circuit included an Order of its own. If signed the Supremes would have affirmed the circuit court's Opinion, and left matters at that. Many experts thought that's what the Supremes would do. But they took a different course. In the end, they may come to the same conclusion. But time will have been wasted.

Even in ordinary cases, lawyers filling motions include an order they hope the judge will sign, in addition to granting the motion.
