I'm not sure, but it may be possible cohen's only criminal record is doing something illegal (that he was caught at) performing on shittypants's orders.

It would be in court like: "Mr. Cohen, we may negatively judge you on your previous convicted criminal record whereas you broke the law following er.. your boss, um, Mr. tRump, who ordered you to break the laws, ah um ah for him?"
