Yes they issued an 8K but they did not give any financial information with it. The understanding was that they would issue an 8K with the information that would normally be in the 10K. If it was an issue with paying the auditor they still should have had the financials completed as well as all the notes to the financials. They produce them and the auditor reviews and verifies everything.
