My interest was piqued that Berman parted ways with Herzog (his lawyer) as soon as this judgement came in.

2 possibilities occur.
(i)Berman is Boracic and can no longer afford to retain the services of his long time consigliere.
OR
(ii) Keith may not have been to impressed at his counsel's admission that their reticence to respond to this action was effected with deliberation:

Defendants conceded at the hearing that their failure to respond to the Complaint was a “strategic decision”

... wherein Herzog admitted that they decided to prioritise the other cases (criminal and SEC) rather than responding to this one!

This was not the only basis on which the case was lost by any means, but it does show a level of disrespect for the court proceedings, which amounted to a "sorry guys, but we've got bigger fish to fry here!"
That admission would not play particularly well in any court, and might very reasonably be considered a massive own goal that backfired spectacularly! And if it was my lawyer making that concession unilaterally, or else failing to caution robustly against such a course of action well .... I would not be best pleased in either event.

Anyhow, Its nice to be back on the DECN popcorn here, and I'm looking forward to the second reel of this epic saga when it kicks off again! And I guess we'll get a sense of which of these it was as the subsequent events unfold!
