F&F voluntarily buying up toxic mortgages during conservatorship--which may or may not have happened--and F&F suing banks for misrepresenting the quality of their mortgages are separate events.
Simply put, if F&F knew the mortgages were toxic when they bought them leading up to '08, they wouldn't have be able to sue the banks for misrepresenting them.
