I think it is highly unlikely SCOTUS will hear WDDD's case. As I posted earlier, in Axle v Neapco, there was the perfect opportunity to finally clarify the 2 step Alice test. The Federal Courts were deeply divided in the case and crying out for clarification. Even the Solicitor General took the rare action of providing a brief asking for clarity. SCOTUS demurred.
