Psssst reaper. I left it out because it didn't apply to the OTC! Read it again:

That is actually in a case where the safe harbor is available to the company but their statements went well beyond the protection it would provide.


Here's the thing, I posted the article thinking the "Forward-Looking Statement" / "Safe Harbor Disclaimer" applied to any company anywhere that might use it. But that person said it does NOT apply to ANY tickers in the OTC! And after a bit of checking I found out that the company in that article last traded for $111.50 on the NYSE! And that was the reason for his first comment and the reason I omitted it. It simply wasn't relevant! But the rest of his post was relevant to the OTC. Here it is again:

In the case of OTC penny stocks the safe harbor is not available AT ALL in any way.

Many don’t realize this, because many OTC penny stocks use it. It isn’t until they go an try to rely on it in defense of a civil claim or regulatory action that it becomes an issue.

Everything that the company or it’s officers have said is not covered by it.


So, now I'm wondering (trying to find out the TRUTH), are you saying that person is WRONG and that the disclaimer DOES apply, also, to OTC penny stocks?

I'll wait your response so I can forward it to that person and get his comment.
