Plaintiff has standing which was affirmed by the appeals court and previous rulings from judge Lamberth in 2018. Summary judgment can only be ruled without fact issues. Since contradictory facts were provided by plaintiffs and defendants, fact finders, such as jury are needed. So the case will be allowed to proceed to trial. But the Berkeley jury trial request may be denied, and it is ok to do bench trial. Class action is jury trial.
