I guess we are in agreement overall about the courts. The rulings with regard to shareholders have been consistently non-win. SCOTUS has maintained lower court rulings WRT to shareholder recompense.
If forced to guess, I would say SCOTUS views its mission primarily to find a way to maintain the common law framework without paying a penny to shareholders in the GSE lawsuits. SCOTUS did clarify some things in Collins that point to this.
