Is it Amarex's job to make sure a trial is statistically significant? CRO executes trials, the company is responsible for the trial design. The trial design and sample size are company designed -- they pay for it and they are accountable for the trial. NP had repeatedly touted how good Amarex was, never complained about the numerous trials they operated. Then when Amarex has $12 million in past due bills they want to get paid for and hold the company data until they get paid. Then NP decided to throw them under the bus and fire them so he didn't have to pay them. So far, nothing has been proven about any deficiencies in Amarex's performance.

Amarex, in their defense, released the NP email showing that NP specifically directed them to file a knowingly incomplete BLA. Which NP decided to blame the for the incomplete BLA. Surprise, SEC and DOJ are now investigating NP and Cytodyn for the whole sorry BLA event. CyDy can't pony up the surety bond to get back the clinical data and start a audit of Amarex's activities to substantiate or refute the billings. Have a hard time accepting NPs sudden turnaround from Amarex fan to suing them to get out of paying them.
