My understanding - memory from 100 years ago --
Dividend was payable up to cash - profit earned !!! HERA did not say that was not payable
Now - if one thinks of the LP as something that might be negotiated away at the end ---- it would have been GREAT and GREATER if under HERA --- the FHFA made F and F issue SHARES v cash from day one !! That was allowed but not required --- but IMO is what should have been done at companies the GOV said were cash poor
