Correct.
I had misgivings about Collins when filed. But because of Collins:
1. Calabria and Mnuchin ended the NWS after the enbanc ruling.
2. SCOTUS ruled that plaintiffs are entitled to retrospective relief if they can prove that they were harmed because POTUS was unable to fire the Director of FHFA at will.
3. SCOTUS ruled FHFA is the GOVERNMENT. Although shareholder rights were transferred to FHFA during conservatorship, every citizen has the right to sue for takings.
I still have misgivings about the relief sought by Collins. But Collins moved us leaps and bounds from where we were before enbanc and SCOTUS. God bless Collins and his co-plaintiffs!
