Two good opinions from ST:

My guess is we lost for 2 reason. First, the jury of our peers, as they usually do, have potato brains and couldn’t see thru BS.
Second, NLST’s sloppy record keeping.
It seems to me they trusted Samsung in the beginning, so they didn’t bother keep track of all their orders. The jury heard things like 50% of the orders were filled.
The rest that didn’t cost a measly 4-5% more. It isn’t true but that was the data our expert had to work with. I’m not a lawyer, but as an accountant, that stood out to me yesterday."
