My guess is they have not been retained by the website owner but are helping in some initial info gathering to see if there is something there there. Perhaps this is part of their “Free Case Evaluation”.

Usually non-reporting OTC don’t get sued because they have nothing to recover.

But in this case there is some serious money on the table and on paper Foote is worth a lot.

Hopefully his D&O premiums are paid up.
