***BOMBSHELL*** The FHFA dodged the U.S. Supreme Court's ban on eviction moratoriums approved by Federal Agencies, arguing that Congress must specifically authorize it, directing FnF to announce it instead of the FHFA, like it did with the announcement in July, when the eviction moratorium was extended through September 30th. Yesterday, it was FnF the ones that extended it "indefinitely", not FHFA, but it turns out that FnF don't have Powers to make such announcement. The powers of the management, equity holders, BOD and the enterprises, were transferred to the conservator on day one of conservatorship, pursuant to the FHEFSSA's Succession Provision. The FHFA has 6 days left to release FnF from conservatorship, so that this announcement is legally enforceable.
