IMO, CYDY knew from the start that they wouldn’t be successful in stopping the vote. They thought, wrongly, that they could call the 13d’s bluff by taking them to court, but the 13d was well funded and didn’t back down. IMO, CYDY offered a settlement because the legal bills likely reached the $1 million + range and that’s a considerable amount when you factor in all the legal costs from this year and the decreasing cash position.

The vote is going to take place and someone is going to win. Let’s hope it’s the 13d, that way when the DOJ hauls Nader away to jail (this is a possibility, IMO), it doesn’t effect the share price.
