i was wondering about that...kblb had to pay ND about $265K and had 2 yrs to do it...as of March, they still owed like $200k...one of the clauses that allows ND to terminate the licensing agreement is kblb defaulting on the payments...i can only hope with all the dilution occurring, that kim managed to pay the loan...or he wrote a check using money in the bank...
i wonder if, after 12 years, ND is pretty much over all of kim's promises and lack of performance?...
how much time is left on those patents?...the way i ubderstand it, the clock starts clicking way before they are granted...does kblb even have 10 yrs left on them?...
it appears that ND never lifted a finger or paid anything to obtain those patents...its been all kblb doing it...how much does ND even care?...they've got 6.2 mil shares of kblb and have never made a dime off of them..the same with royalties...
everyone is assuming that ND will spend large amounts of money to fight any patent infringements...why would they?...what is the incentive?...kblb has never given them one...
is ND supposed to spend a ton of money fighting patent infringements on patents that havent been worth a nickel to them?...
from what i can remember, if ND decides not to pursue any patent infringement cases, it falls to kblb to do so if they choose...ND will do whatever is necessary as long as kblb pays for the suit...
as of right now, after 12 years of NOTHING, i dont see ND falling all over themselves to defend patents that they didnt even bother to obtain themselves...
2% royalties on MS aint much and likely will never be much...6.2 mil shares at a buck is $6.2 mil...not a large sum for ND...IF it ever DOES get to a buck per share...
any entity recently deciding to enter this field is well aware of who is who and who has what...including patents...so if they decide to proceed, i assure you, "cease and desist" letters will be laughed at and filed away...
like i always said, patents are only as good as your ability to defend them...and ND has very little incentive to do so...kblb has little ability to do so...
the patents would be great if kblb owned them and a large entity could thus own them in a buyout...but in a buyout, the buying entity would have to negotiate their own deal with ND...
many state that the patents are worth billions...lol...even if that WERE true, they would be worth billions to ND not kblb...
having said all that, this latest patent is a good thing...its a positive...most wont have a clue that kblb wont own the patent...and its apparent kim would like to keep it that way...
