Thank you judges Northstar42 and MJBaker84 for presenting your legal interpretations. While I was accepted for several law schools, I chose a different course.
So, unfortunately, I do not claim any legal expertise.
Fortunately, this issue will be dealt with independently of our thoughts and opinions. I see the defendents listed individually and "Yes," it does not include some of those originally listed as part of the 13d group.
Listed additionally is the CCTV PROXY GROUP, LLC. It's a little unclear who or what that involves and what they may or may not have to lose. In any case Sibley Austin will, I suspect, resolve this issue.
I also remember, in the 33 page filing, when Sibley Austin was listing "charges, " individually - they ended each item stating that the offending action had (my words >) irrevocably harmed the shareholders of CytoDyn. (Which is ironic since the 13d group claimed they ostensibly were here to help the shareholders, LOL)
And in fact the named individual(s), and CCTV PROXY GROUP have "harmed the shareholders of CytoDyn," so it seems fair this "harm" should be redressed in an appropriate manner. I guess CytoDyn, in conference with Sibley Austin, will ultimately decide how best to address the issues at hand.
What's ironic is, I would have listened and countenanced reasonable ideas if they had been set forth. Hearing/reading only generalities sans details made me uneasy, and finally when the "real story" re: this attempted subterfuge were revealed, it was shocking!
I suspect many others feel similarly - thus the resurrection of the "Rosenbaum-Patterson, we make it up, so it sounds good, but is just to get our foot in the door and screw everybody but ourselves team" (B-Pwmiusisgbijtgofitdasebo team, for short) is not going to be the 'second-coming. In fact the B-Pwmiusisgbijtgofitdasebo team probably (along with the mysterious membership of the CCTV PROXY GROUP) have their hands quite full as their lawyers leave no stone unturned - with the clock(s) running - and those legal bills just keep on cranking up >>> trying to save their collective butts.
