Of course I'm biased but I find the appeal request compelling. Distilling the arguments down to their essence: 1) WDDD makes the point that their technology allowed MORE users to play. This obviously represents an improvement of the network (patentable), not simply "crowd control"of restaurant elevators as analogized by Caspar. 2) WDDD's technology also allowed participation of players with older/legacy computers. Once again, an obvious improvement, not simply filtering. 3) In the previous IPR's WDDD's patents passed the "Alice" test.
