My interpretation of the 10-K Language is that the SEC and DOJ are investigating if statements made by NP fall outside of safe harbor and forward looking statements category. The FDA letter is a big deal as well as what CYDY knew regarding trial results and when they knew it. It is possible the DOJ a is also investigating purposeful conduct on the part of NP to fail prolifically for profit from another source.
