Here is a link to the article. It says that the AIG case is different than the GSEs because AIG would have had no value had the government stepped in a saved them. The GSE claims are challenging the third amendment where the GSEs already had value, not the entire conservatorship. So the claim is different than AIG. The government cannot use the same argument and not pay for the taking because the GSEs had value and continue to have value after the taking.
