Everything you said seems fine. Jake seems to be suing because he can't trade the shares given and JT/NSAV (at last check) has yet to respond. What you said seems like a good offer.
Can't ask for more from JT then to either lift the divi share restrictions (if they is one) or give those divi holders instructions on how to get them tradable. I think I read that it is quite costly but I dunno for sure. It's just that the issue has been ignored for so long.
And, let's face it, the offering of those divi's were an incentive to buy more shares. Well, imo.
