A person with temporary permission to be in the United States under a student visa would not be under the "jurisdiction of the United States" because their allegiance is to their home country. Harris’s parents were from India and Jamaica, and they were students in the United States when they met and had not been here long enough to apply for citizenship.

EXP. If my husband and I were attending school in some European country and had a child, that child would be a citizen of the US., our home country.

Anchor babies are automatically US citizens because they were born here. That law should have been changed eons ago. We now have thousands of anchor babies that live in Mexico but are US citizens and therefore entitled to all the benefits of a US citizen including education, free lunch, and even SS benefits.
