DOJ is filing a "brief" because:
1. They are rssponding to one of our briefs.
2. They want to bring up new evidence..not available originally.
3. They want to summarize their position, and "sell it".
4. The judge may require them to do so.
In law, both sides should have an opportunity "to tell their side of the story." They may try to refute what the other side said, with evidence.
The judge wont render a decision until both sides have been given a chance to be heard. And, that is fair.
