While it's mainly doom and gloom today, let's look at the bright side of the ruling:
1) Calabria is out.
2) Regarding standing:
"Because the relevant action in this case is the third amendment, and
because the shareholders’ concrete injury flows directly from that amendment, the traceability requirement is satisfied." Pg 19
All lawsuits can proceed.
3) Retrospective relief:
"By contrast, they retain an interest in the retrospective relief they have requested, and that interest saves their constitutional claim from mootness." Pg 19
4) Right to sue:
"Here, the right asserted is not one that is distinctive to
shareholders of Fannie Mae and Freddie Mac; it is a right shared by everyone in this country. Because the succession clause transfers the rights of “stockholder[s] . . . with respect to the regulated entity,” it does not transfer to the FHFA the constitutional right at issue." Pg 21
Only shorts made money today. If the litigants are willing to proceed, those who bought today, will make money after Collins remand, Lamberth and Federal Court of Claims. I stayed put as I am fully invested already.
